[ l L AN ORDINANCE RELATING TO ADOPTION OF ADMINISTRATIVE CODE FOR SCOTT COUNTY AND REPEALING THE ADMINISTRATIVE CODE ADOPTED 12-19-78 STATUTORY AUTHORIZATION, FINDINGS OF FACT, PURPOSE AND OBJECTIVES: A. House Bill 33 was enacted by the 1978 General Assembly of the Commonwealth of Kentucky to create a new section of Kentucky Revised Statutes (KRS) Chapter 68 for the purpose of sound and efficient administration of county government. The new section of KRS Chapter 68 states, in part, that the fiscal court shall adopt a county administrative code which includes, but is not limited to, procedures for designation of responsibility for: (i) General administration of the office of the County Judge/Executive, county administrative agencies, and public authorities. (ii) Administration of county fiscal affairs, including budget formulation, receipt and disbursement of county funds and preparation of records required for the county audit, and for filing of claims against the county. (iii) Personnel Administration, including description and classification of non-elected positions, selection, assignment, supervision and discipline of employees, employee complaints and the county affirmative action program. (iv) County purchasing and award of contracts. (v) Delivery of county services. B. The County Judge/Executive, as the chief executive officer of the county, is directly responsible for the organization and management of the administrative functions of county government. While it is the Fiscal Court which determines county needs, and the policies and priorities for meeting those needs, it is the County Judge/Executive who must see that these policies and procedures are effectively and properly executed. C. The statutes provide only general guidance as to the form and substance of a county's internal administrative organization. In lieu of many detailed statutory restrictions and directions, the 1978 amendments to KRS 67.080 call for the preparation and adoption in each county of an "Administrative Code" as a formal internal guide to the day-to-day operations of the County government. The Code will provide each county with an opportunity to spell out, in terms of local needs and circumstances, procedures and responsibility for the basic elements of internal county administration, including fiscal management, personnel, purchasing, and delivery of county services. D. As the ground rules of the administrative function within county government, the Cade constitutes formal internal procedures established by the County Judge/Executive with the approval of the Fiscal Court. The Fiscal Court should be closely involved in the preparation of the Code, and in the design of subsequent amendments, which not only will enhance the Fiscal Court's understanding of the working of the county administration, but also
