L l L COUNTY OF SCOTT, KENTUCKY ORDINANCE NO. 01-04 AN ORDINANCE RELATED TO THE LOCAL ADOPTION OF MANDATORY RADON PROTECTION IN ONE AND TWO FAMILY DWELLINGS WHEREAS, Scott County has enforced radon protection in newly constructed one and two family dwellings based upon the 1995 CABO Code adopted by Scott County by Ordinance No. 98-04, enacted July 13, 1998; and WHEREAS, Section 324.1 of the 1995 CABO One and Two Family Dwelling Code, which mandated radon protection for one and two family dwellings constructed in zone 1 as shown on the Environmental Protection Agency (EPA) Map of Radon Zones, conflicted with Subsection 310.7 of the Kentucky Building Code (KBC) which reads, "Radon measure shall not be mandatory unless specifically required by local Ordinance." Legislation effective July 15, 1998 required all single family dwellings to be constructed in compliance with the KBC; and WHEREAS, The conflict between CABO and KBC was resolved by formal interpretation No. 98-25 issued by the Board of Housing, Building and Construction issued October 15, 1998 which declared construction in substantial compliance with CABO, except for the radon protection, is in compliance with KBC; and WHEREAS, Subsection 310.7 of the KBC authorizes local government to require radon protection by specific local ordinance. The EPA, Surgeon General, Centers for Disease Control and other major organizations recognize radon as a carcinogen and serious threat to the public health. Scott County is located in Zone 1 of the EPA Map of Radon Zones indicative of high risk of radon exposure. The purpose of this ordinance is to specifically require protection against radon in newly constructed one and two family dwellings as authorized by KBC subsection 310.7. NOW, THEREFORE, BE IT ORDAINED BY THE FISCAL COURT FOR THE COUNTY OF SCOTT, KENTUCKY: Subsection 1. Scope. All one and two family dwellings constructed after the effective date of this Ordinance shall be constructed with the radon protection measures described in Appendix F of the 1995 CABO One and Two Family Dwelling Code. Subsection 2. Effective Date. This Ordinance shall take effect upon passage and publication.
