l l L SCOTT COUNTY, KENTUCKY ORDINANCE NO. 02-03 AN ORDINANCE RELATING TO A ZONE CLASSIFICATION CHANGE FOR 53.199 ACRES± LOCATED AT U.S. 25 NORTH AT ROGERS GAP ROAD, IN SCOTT COUNTY, KENTUCKY FROM A-1 (AGRICULTURAL) TO Rl-B (SINGLE FAMILY RESIDENTIAL) PUD WHEREAS, the application of Land and Timber, Inc. having been properly filed with the Georgetown-Scott County Planning Commission (Planning Commission) to change the zone classification on certain real estate located in Scott County, Kentucky, consisting of 53.199 acres ± and located on U. S. 25 North at Rogers Gap Road, Scott County, Kentucky, from Agricultural A-1 to Single Family Residential (Rl-B) PUD; and, WHEREAS, this matter having been considered by the Georgetown-Scott County Planning and Zoning staff and further evidence and/or testimony concerning said application was heard before the Planning Commission at a duly noticed public hearing on February 14, 2002; and, WHEREAS, after said public hearing the Planning Commission voted to recommend to the Scott County Fiscal Court that the requested zone classification change be granted on the southern most 2.88 acres± of the aforesaid 53.199 acre tract and to deny the zone change for the balance of the property as premature since it was not consistent with the Comprehensive Plan for Scott County. WHEREAS, the Scott County Fiscal Court having considered the record of the planning commission's public hearing of February 14, 2002, the recommendations of the planning staff and the petition of the applicant for the zone change and being otherwise sufficiently advised hereby makes and adopts the following findings of fact: FINDINGS OF FACT: A) That since the adoption of the 1996 update to the Comprehensive Plan there have been major changes within the area where the land subject to this zone change is located such as: I) The location of the new fire station at U.S. 25 and Delaplain which brings the location o fire protection services nearer to the cluster of rural residential developments in this part of the county; and
